Judge Reserves Decision In Judicial Review

Justice Mona Lynch has reserved her decision in the judicial review between the South Shore Regional School Board and Town of Bridgewater.

The two sides spent roughly four hours arguing their points today at the Bridgewater Justice Centre.

The Town of Bridgewater was arguing that the school board did not follow procedural fairness in its decision to move grade 10-12 students from Bridgewater Junior-Senior High School to Park View Education Centre.

The town also felt the board misled the school options committee with directions and failed to properly follow the provincial school review policy.

Meanwhile, the school board argued they adhered to the process as its laid out and made a decision to send students from Bridgewater Junior-Senior High to Park View based on thorough evidence and recommendations.

Chair Elliott Payzant believes the judge doesn’t have an easy decision.

“I think it will be looked at by other municipalities or other towns, depending on what happens here, if they didn’t like a decision that the school board made.”

Payzant goes on to say that he believes both sides were heard and feels the judge understands the situation.

The lawyer representing the Town of Bridgewater declined comment.

Justice Lynch did not provide a date when her written decision will be released but understands timelines are tight and would try and respond quickly.
