Jury Deliberating In Trial Of Mother Accused Of Daughter`s Death

Deliberations have begun in the second trial of a Mount Pleasant woman charged in the 2013 death of her daughter.

A mistrial was declared in the case against Candice Roxanne Moore in March when the 12 person jury was unable to find a verdict.

Closing statements came this morning with the prosecution arguing it was “clearly foreseeable” Moore’s actions would put 9-year-old Olive Moore in danger.

The crown says a failed an approved screening device* along with a disregard of poor road conditions show Moore wasn’t putting the safety of her daughter first.

The defence, after choosing not to bring any evidence, says while the outcome is tragic it was by no means foreseeable.

They say she was driving slowly and had asked Olive to step away from the vehicle.

The jury is now sequestered.

A verdict could come back as early as this afternoon.

*A previous version of this story indicated there was a failed breathilizer reading. We have corrected it to “approved screening device”.
