In the ruling, Justice Duncan Beveridge issued that a new second degree murder trial be held for Terry Roy Levy.

Read the full decision by the Nova Scotia Court of Appeal.

He was found guilty in the July 2014 death of Terry Green after shooting him three times.

The decision states the trial judge misdirected the jury on the intent required to establish murder and erred in his instructions on self-defence.

Levy was sentenced to life in prison last May with no chance for parole for 11 and a half years.

A new date for the second degree murder trial is not yet known.
