The MV Farley Mowat remains in Shelburne despite a second deadline to remove the vessel.
A first deadline was given April 8 but was extended to April 22 due to weather conditions.
Tracy Dodds is due in court on Wednesday and is in contempt of the court order to remove the vessel by the deadline.
He faces a 20-day jail sentence.
Meanwhile, Mayor Karen Mattatall says the town will wait and see what happens in court before deciding next steps.
The town is owed more than $40,000 from Dodds in unpaid berthing fees.
